The Terms of Use apply to all users of our services, including (without limitation) users who browse or access content on the Bigfollow.ch website (the "Website") or who use our services in any other way.

The Company reserves the right to change the Terms of Use at any time. Such changes will become effective as soon as they are posted on the Website. You are obliged to keep yourself informed of such changes and to comply with them. Your continued use of our services following the posting of changes to the Terms of Use constitutes your acceptance of the modified Terms of Use.

In addition to the Terms of Use, further conditions may apply to certain services. If these conditions conflict with the Terms of Use, the specific conditions for these services apply.

Website use

Bigfollow.ch (the "Company") provides certain services, including social media engagement and subscriber services (collectively, the "Services"). The Services can be purchased online through Bigfollow.ch.

By purchasing the Services, you agree to pay the stated purchase price and further agree that:

(a) you have the authority to make such a purchase

(b) you have the authority to use or access the social media account associated with the purchase

You acknowledge and agree that all sales are final and that refunds will only be offered in accordance with the terms of these Terms of Use and the Refund Policy posted on Bigfollow.ch. Other refunds will only be granted at the sole discretion of the Company.

Copyright

All content, including text, images, sound, video and code (collectively referred to as "Intellectual Property") found throughout Bigfollow.ch is the intellectual property of the Company and is protected by applicable Swiss and foreign copyright, trademark and patent laws. They are expressly owned by Bigfollow.ch or other copyright owners who have given express permission for their information to be used on the Bigfollow.ch website.

You may not use, reproduce, modify or distribute the Intellectual Property without the express written permission of the Company. The Company reserves the right to take legal action against any violations of these Terms of Use.

Limitation of liability

Under no circumstances will the Company be liable for any damages, liabilities or losses, whether in contract, tort or otherwise, arising out of your use of Bigfollow.ch or the Services. You understand and acknowledge that your use of the Services is at your own risk.

This includes, but is not limited to, any damages, liabilities or losses arising out of the use of or inability to use the Services, errors or omissions in the Content, or unauthorized access to or alteration of your transmissions or data. The Company does not warrant the accuracy, completeness or usefulness of any Content available on the Site.

If the customer provides incorrect information when placing the order, Bigfollow.ch is not obliged to deliver the order. The company is not liable for incorrect information provided by the customer when placing the order.

Behavior

You agree to use Bigfollow.ch solely for lawful purposes and not to jeopardize the security of the website, make it inaccessible to others or cause damage to the content, the service or the website. As a user, you agree to refrain from any action that may add, subtract or alter the content of the website. You agree not to access the Content without permission and not to use the Website in any manner other than that for which it is intended.

The Company reserves the right to restrict or terminate your access to Bigfollow.ch at any time without notice.

Confidential information

Bigfollow.ch undertakes to treat all information submitted by you and relating to the processing of service orders as confidential. Any other material or information sent to the website will be considered non-confidential. You hereby grant Bigfollow.ch a royalty-free, irrevocable license to use, display and distribute the submitted information in any manner it desires.

Correction of inaccuracies

Bigfollow.ch reserves the right to correct any errors or inaccuracies in the content of the website or to change and update the content at any time without prior notice. However, the company does not guarantee that errors, inaccuracies or omissions will be corrected immediately.

Responsibility of the customer and verification of orders

The customer is responsible for checking whether the order has been delivered in full. Please note that it can sometimes happen that orders are blocked by the algorithm of social media platforms. We will do our best to deliver all orders in full, however the customer must contact us within 7 days of placing the order if there are any discrepancies.

Provisions

These Terms of Use with Bigfollow.ch govern the relationship between you as a user of the website and the Company in relation to your use of the website and the services provided by it. They constitute the entire agreement between all parties with respect to the subject matter hereof and supersede all prior agreements and understandings, whether written or oral. By using the Website, you accept these Terms of Use and the associated terms and conditions. If you do not agree to these Terms of Use, you may not use the Website.

Leaving the service

The term of this agreement between you as a user and Bigfollow.ch begins with the acceptance of your order by the company and ends with the termination by one of the parties. This agreement may be terminated in writing by either party.

Bigfollow.ch reserves the right to withdraw your participation in the use of the website and the services provided by it at any time and without giving reasons. This applies in particular if the company determines, in its sole discretion, that you are abusing the system. In such a case, Bigfollow.ch reserves the right to retain all amounts that have been withheld for you. However, it should be noted that Bigfollow.ch has no obligation to monitor or prevent misuse of the system.

Delivery times and delays

Regular delivery time
We endeavor to start or deliver your order within 2-48 hours.
Possible delays
In rare cases (e.g. system overload or very large orders), delays may occur.
Partial deliveries and refunds
As soon as the delivery of your order has been started (even partially), the service is considered to be in progress. Cancellation or refund is then no longer possible.
However, if it is not possible for us to fulfill the order in whole or in part for technical or other reasons, we will refund the proportionate or full purchase price.
No claim for reimbursement in the event of delays
If there are only delays (e.g. due to system overload or high order volumes), there is no entitlement to a refund.

Third-party marketing campaign

No other marketing campaigns may be run during your Bigfollow.ch marketing campaign. We use public statistics to measure the results of our campaign, which may be disrupted by other campaigns. If you run other marketing campaigns at the same time as the Bigfollow.ch marketing campaign, you agree that the company is responsible for every fan, follower, view, comment, visit and/or vote you receive during the duration of your Bigfollow.ch marketing campaign.

Social media account

Bigfollow.ch is in no way liable for accounts, photos, videos and/or tracks that are removed due to the implementation of our services or your interaction with the company. It is nearly impossible to determine why social media account providers block or delete accounts or content. All purchases of services are at your own risk. For this reason, we are unable to provide refunds upon completion of services if this has happened to an account/content.

Delivery of the service

Bigfollow.ch may over-deliver the services it guarantees, including but not limited to delivering additional followers or subscribers than ordered. This over-delivery amount ("Extras") should be considered as a buffer in case of a small loss of followers or subscribers. Extras are not covered by the Company's retention guarantee and Extras are not replaceable in the event of a loss equal to or less than the Overdelivery Amount.

Storage guarantee

Bigfollow.ch offers a limited retention guarantee/warranty for some of its services. If a customer uses any of Bigfollow.ch's services and then loses followers, likes, views and/or games purchased from Bigfollow.ch (beyond the extras), the company may, at its sole discretion, reinstate followers, likes, views and/or games free of charge. Each service offers a different duration for Bigfollow.ch's retention guarantee, which is listed below:

The Bigfollow.ch retention guarantee applies under the following conditions:

(1) The customer has at some point ordered from another company, person or service.

(2) The customer's customer account has experienced a reduction in followers/likes/views/plays acquired before the order was placed at Bigfollow.ch or by other means.

(3) The customer makes his account/page/video/photo/track private, restricted or otherwise inaccessible during and/or after a campaign (e.g. by changing the customer's user name).

(4) If a customer blocks/deletes/bans the followers/likes/plays/views received from Bigfollow.ch.

The Company shall make a final and non-appealable decision on all applications for a retention guarantee.
